Bramley Shop sell unsafe food

On the 22nd January 2026, Nadr Osman trading at Euro Bramley Shop, 10 Bramley Centre, Lower Town Street, appeared at Kirklees Magistrates Court to answer a case brought by West Yorkshire Trading Standards Service (WYTSS) for having for sale food that was past its Use By date. The case was launched after WYTSS conducted  an inspection in January 2025. On inspection 69 items, collectively totalling 546 days past the use by date, were found by Trading Standards Officers from WYTSS.

 

Foods with a ‘Use By’ date are highly perishable and should not be sold nor consumed after the date marked on the packaging. Once past their ‘Use By’ date they are deemed unsafe for consumption and thus it is an offence to make such items available for sale.

 

Mr Nadr Osman pleaded guilty to six offences under Regulation 19(1) of the Food Safety and Hygiene (England) Regulations 2013 and was fined £736,   and ordered to pay a victim surcharge of £294 and costs of £2200.

 

David Strover, Head of Trading Standards  -  Business Services said “food businesses should ensure that they undertake regular date checks on items bearing use by dates and  they should invest in appropriate staff training and ensure food bearing a use by date is not exposed for sale after that date. It is the responsibility of food retailers to ensure such checks take place. Use by dates are placed on foods which are highly perishable from a microbiological view and are therefore likely, after a short period, to constitute an immediate danger to human health. Trading Standards will continue to take action against any businesses flouting the law.”

 

Councillor Pauleen Grahame, Member of the West Yorkshire Joint Services Committee which oversees the work of Trading Standards said “Ensuring food safety is a fundamental responsibility of retailers. Selling food products past their use-by date not only undermines consumer trust but poses potential health risks. West Yorkshire Joint Services is committed to protecting the public, and tackling those businesses who supply unsafe food.”
